The Cabinet of Ministers at a meeting on April 4 approved and sent to the Verkhovna Rada a bill that transfers agricultural land that has been allocated for permanent use to farmers and their descendants. This is reported by the Ministry of Agrarian Policy and Food of Ukraine.
It is all about the transfer of about 0.5 million hectares in all regions of Ukraine in the ownership of more than 25 thousand people.
"Ukrainian land should be owned by Ukrainians, and farmers should have agricultural land, not large landowners and agro-holdings. We are submitting this very important law and restoring social justice to farmers – those who were at the roots of the farm movement," Prime Minister Volodymyr Hroisman said. Land for farming was transferred in the 1990s on the grounds of lifetime inheritable possession and permanent use. However, as a result of amendments to the legislation, the possibility to formalize these plots and transfer them by inheritance was excluded, which created legal problems for a large number of farms.
"By adopting this draft law, we are taking a decisive step towards restoring social justice and suggest transferring land that was already in use in the 1990s to farmers or their heirs in ownership. It is 100% agreed with the Association of Farmers and Private Landowners. I hope that the Ukrainian parliament will also support it," First Deputy Minister of Agrarian Policy and Food Maksym Martyniuk said.
The bill "On Amending Certain Legislative Acts of Ukraine Concerning the Transfer of Ownership of Farms to Land Plots, a Lifelong Inherited Possession for the Creation and/or Management of a Farm Enterprise" provides that land plots granted to the founder of the farm for permanent use or lifelong inherited possession. At the request of the founder they are transferred to the ownership of the farm.
Depending on the location of the site, the application is submitted to the local department of the State Service of Ukraine for Geodesy, Cartography and Cadastre or the local government. The application shall be accompanied by technical documentation for the site, copies of documents confirming ownership, and in case of death of the original recipient, a document confirming the right of inheritance.
The total area of land that can be transferred to the ownership of farms is more than 543,508.9 hectares. This decision is another component of the integrated course on support and development of farming in Ukraine, which is implemented by the government.
