What kind of changes in the use of land collective ownership will be held in the new year: an analysis of the law

Owners of land plots of all forms of ownership have the right to exchange them within the same land mass, and land plots under a forest belt can be transferred for permanent use or for rent. This will be provided by Law № 2498-VIII on collective ownership of land, adopted in early July 2018. This is stated in the infographic, published on AgroPolit.com.

It bears reminding that the law of the land of collective ownership will work from January 1, 2019.

The document provides that from the beginning of 2019, the lands of suspended collective agricultural enterprises (except for those that will be privately owned at that time) are considered property of the territorial communities whose territory they are located in. On the basis of this law, it is possible to register the right of communal ownership of such land.

In addition, if by January 1, 2025, the owner of an unclaimed share or his heir did not register the right of ownership, it is considered that he refused to receive the land plot. However, if the heir could not execute the documents for valid reasons, the court may give additional time for this.

If this does not happen, the unit is transferred to the communal property of the territorial community as abandoned. It can be transferred to private ownership in seven years.
